GENERAL CONDITIONS

1. Contractual agreement / jurisdiction
a) FU International Academy Tenerife is your contractual partner for your language course in Heidelberg. We are a subsidiary of FU Group of schools in Germany. As the FU Central Promotion Office we act as an agent of the FU Language School in Heidelberg which is in charge of the execution, development and supervision of the language programmes.
b) The contract is valid as soon as enrolment in a course is confirmed by FU International Academy Tenerife
c) Any arrangements which differ from the following contract terms and conditions are subject to written confirmation by FU International Academy Tenerife
d) In case of legal disputes Spanish law is to be applied.

2. Contractual obligations
a) The contractual obligations covered by this contract are binding.
b) No classes are held on public holidays (see prices and dates). For courses in Heidelberg, holidays are made up by additional lessons on other days. Other language schools offer no compensation for holidays.

3. Methods of payment
a) The payment can be made by bank transfer or Credit Card (Visa, MasterCard or Maestro).
b) The student is responsible for any bank charges.

4. Terms of payment
a) All registrations must be accompanied by a deposit of € 150 to cover initial costs. This payment shall be made by bank transfer or credit card (Visa, MasterCard or Maestro) to FU International Academy. This amount will be deducted from the final total due. No application for registration will be processed without this deposit. The remainder of the amount due shall be paid 15 days before commencement of the course booked. Failure to do so will be considered as a cancellation.
b) The participant bears the cost of all bank charges.
c) In case of registration less than 15 days before the starting date of the course, fees are payable in full upon receipt of the invoice.
d) For courses of more than one month’s duration, payment in instalments can be arranged.

5. Terms of payment for applicants requiring a visa
a) After receipt of the participant’s enrolment, a confirmation of admission to the course and an invoice for the language course and accommodation will be issued. At that time the payment of 100 % of the balance shall be made.
b) After receipt of the payment an invitation from the German Embassy or Consulate will be issued. The applicant shall bear the costs for the express delivery by UPS or any other forwarding agency.
c) In case of postponement of the course start date, no charge will be made (with exception of costs of UPS, etc).
d) In the event of the visa not being granted to the applicant, we guarantee that we will transfer your advance payment back to the applicant after deducting the costs for the express delivery by DHL, UPS or any other forwarding agency and the cancellation fee of Euro 50. FU International Academy cannot be held responsible if the visa application is rejected for whatever reason.

6. Cancellations
a) If a student decides to cancel their place on the programme they should inform the FU International Academy . All cancellations must be made in writing. The cancellation date will be the date on which the FU International Academy receives the written cancellation. We strongly recommend that you arrange insurance cover to protect you against the possibility of cancellation through illness or accident.

b) A refund will be given but a cancellation fee will be charged as follows:

1) An administration fee of 50 € is charged for all cancellations.

2) In addition FU International Academy will charge a fee according to the following scale:

- 5% of the total amount for the programme, if the cancellation is made between 60 and 45 days before the starting date.
- 10 % of the total amount for the programme, if the cancellation is made between 44 and 30 days before the starting date.
- 15% of the total amount for the programme, if the cancellation is made between 29 and 10 days before the starting date.
- 30% of the total amount for the programme, if the cancellation is made between 9 and 4 days before the starting date.
- 50% of the total amount for the programme, if the cancellation is made 3 days before the starting date.
- 100% in the case of the programme being cancelled on the starting date.

If the student does not attend on the designated date at the place where the programme should take place, the full amount still has to be paid.
If a student leaves of his/her free will or at the request of his/her parents or legal guardians once the programme has started, he/she will not have the right to receive a refund.
The amount of money paid for your travel expenses is not included as part of the programme and is not the responsibility of the FU International Academy. We advise all students to take out a comprehensive travel insurance which covers the cost of their travel expenses in the event of cancellation.

7. Absence from class
a)  The following rules apply to the FU International Academy.
- In classes with two or more participants, individual absences will not be compensated for.
- In one-to-one classes, missed classes may be compensated for, if the centre is given notice beforehand.

8. Responsibilities
a) The participant undertakes to comply with the laws of the country of destination and the rules and regulations of the educational centre. Should the pupil be expelled, for whatever reason, FU international Academy cannot accept responsibility neither can it refund any money. Any extraordinary costs arising from the expulsion will be borne by the participant or his parents (in the case of a minor).
b) It is the responsibility of the student to ensure he/she has the necessary documentation to travel abroad (passport, visa)
c) The student should enquire about personal health and accident insurance. In case of illness, death or accident, responsibility falls solely on the student and will be dealt with according to the conditions in the contract with the insurance company.
d) In case of accident or illness to a student below the age of majority, where it is impossible to contact the father/mother/guardian, the Director of the educational centre is authorised to take whatever measures he/she may consider appropriate for the good of the student.
